This Disclaimer governs your use of the website base1520.com and all programs, courses, digital content, coaching, assessments, and the mobile fitness application (collectively, the “Services”) offered by BASE1520 LLC, doing business as BASE 1520 (“BASE 1520,” “we,” “us,” or “our”), a Louisiana limited liability company. By accessing our website or participating in any of our Services, you acknowledge that you have read, understood, and agree to this Disclaimer. If you do not agree, do not use the Services.

This Disclaimer works alongside our other legal documents, including our Privacy Policy and the liability, media, confidentiality, and conduct Waiver that in-person participants are required to sign. Nothing in this Disclaimer limits or replaces the terms of that Waiver.

Our Services are intended only for adults 18 years of age or older.

1. Not Medical, Psychological, or Professional Advice

The content and Services provided by BASE 1520 — including the Alpha Course, the Gamma Course, the fitness app (powered by Everfit), workout programming, nutrition guidance, the free 7-Day Readiness Challenge, our wellbeing assessments, and any articles, emails, videos, or coaching — are offered for general wellness, fitness, and educational purposes only. They are not medical, psychological, nutritional, mental-health, legal, or other professional advice, diagnosis, or treatment, and they are not a substitute for care from a qualified licensed professional.

We are not your physician, therapist, dietitian, or healthcare provider, and no coach-client, doctor-patient, or therapist-patient relationship is created by your use of the Services. You should never disregard, avoid, or delay obtaining professional advice because of anything you have read, heard, or received through BASE 1520.

Consult your physician before beginning any exercise, nutrition, or wellness program. This is especially important if you are pregnant or nursing, are elderly, are taking medication, or have (or suspect you may have) any injury, illness, cardiovascular condition, or other health condition. Do not start, and stop immediately if you experience pain, dizziness, shortness of breath, or discomfort, and seek medical attention. You are solely responsible for evaluating your own fitness to participate and for any decisions you make based on our content.

2. Wellbeing Assessments and Mental-Health Screening

As part of certain Services, we may offer wellbeing assessments, including the Personal Wellbeing Index – Adult (PWI-A) and the GAD-7 anxiety screening questionnaire. These tools are provided for self-awareness, general wellness, and educational purposes only.

The GAD-7 and any similar instrument are screening tools, not diagnostic tests. A score or result does not constitute a diagnosis of anxiety or any other condition, and is not a substitute for evaluation, diagnosis, or treatment by a licensed mental-health professional. While certain assessments may be reviewed by qualified BASE 1520 personnel, that review is for general program and wellbeing purposes only and does not establish a clinical, therapeutic, or provider-patient relationship, and does not constitute clinical care, diagnosis, or treatment of you.

If your results concern you, please consult a licensed healthcare or mental-health professional.

Crisis notice: BASE 1520 does not provide crisis, emergency, or urgent mental-health services. If you are in crisis, are experiencing a mental-health emergency, or may be at risk of harming yourself or others, contact a licensed professional immediately, call 911, or call or text 988 to reach the U.S. Suicide & Crisis Lifeline, available 24/7.

3. Assumption of Risk — Physical and Firearms Training

The Alpha Course and Gamma Course are in-person intensives that involve strenuous physical activity and, in some sessions, live firearms training and related handgun and situational-awareness instruction. These activities are inherently dangerous and carry real risks — including the risk of serious bodily injury, permanent disability, or death — to you and to others.

Your participation is entirely voluntary and undertaken at your own risk. By choosing to participate, you knowingly and voluntarily assume all risks associated with these activities, whether known or unknown. You agree to follow all safety rules, range commands, and instructions given by BASE 1520 staff and instructors at all times, and to conduct yourself in a safe and responsible manner.

Participation is also subject to a separate written Waiver that you must sign before taking part in any in-person activity. That Waiver contains the binding assumption-of-risk, media, confidentiality, and conduct terms governing in-person activities. This Section is a summary notice only and does not replace, limit, or modify the Waiver.

Louisiana law. Nothing in this Disclaimer or in the Waiver purports to release, exclude, or limit BASE 1520’s liability for causing physical injury, or for intentional or gross fault, to the extent such a release or limitation is prohibited by Louisiana law (see La. Civ. Code art. 2004). If any provision here or in the Waiver is found unenforceable under Louisiana law, it will be limited only to the extent necessary, and the remainder will stay in full force.

Firearms eligibility. You are responsible for complying with all applicable federal, state, and local laws regarding firearms. By participating in any firearms activity, you represent and warrant that you are legally eligible under all applicable law to possess and handle a firearm, and you agree to indemnify BASE 1520 for any loss arising from a breach of this representation. Do not participate in firearms activities if you are legally prohibited from doing so.

4. No Guaranteed Results

BASE 1520 makes no guarantee, representation, or warranty regarding any specific outcome from participation in our Services — including any particular level of physical fitness, weight change, strength, skill, mental or spiritual wellbeing, or ministry outcome. Health, fitness, and personal-growth results depend on many factors outside our control, including your effort, consistency, genetics, starting condition, and adherence.

Individual results vary. Any testimonials, reviews, or success stories we share reflect the individual experiences of the people who provided them. They are individual experiences only and are not typical, not average, and not a promise or guarantee that you or anyone else will achieve the same or similar results. Where a testimonial reflects an atypical experience, you should not expect to duplicate it.

5. Spiritual and Ministry Content

BASE 1520 is a faith-based organization, and our Services include spiritual, biblical, discipleship, and ministry content that reflects our Christian faith perspective and convictions. This content is offered in good faith for encouragement, teaching, and discipleship.

Spiritual and ministry content is not professional counseling, psychotherapy, or medical or mental-health treatment, and pastoral, discipleship, or ministry interaction does not create a licensed-professional relationship. It is not a substitute for care from a qualified licensed professional where such care is needed.

6. External Links and Affiliate Disclosure

Our website and content may contain links to third-party websites, products, services, or resources that we do not own or control. These links are provided for convenience and reference only. BASE 1520 is not responsible for the content, accuracy, availability, products, services, privacy practices, or policies of any third-party site, and a link does not imply our endorsement. Accessing third-party sites is at your own risk, and you should review their terms and privacy policies.

Affiliate disclosure: Some links on our website, in our emails, or in our content are affiliate links. This means that if you click a link and make a purchase, BASE 1520 may earn a commission or other compensation, at no additional cost to you. We also participate in or may join affiliate and partner programs (for example, with recommended equipment, supplement, or apparel providers). We only recommend products and services we believe may be genuinely useful, but our recommendations are our opinions and are not a guarantee of any product’s quality, safety, or results, and any affiliate relationship does not affect the price you pay.

7. Course Enrollment, Payments, and Refunds

Enrollment in the Alpha Course ($2,000), the Gamma Course ($1,200), and other paid Services is subject to the pricing and terms presented at checkout. Card payments are processed by Stripe. Where installment financing is offered, it is provided by Affirm, Inc., a third-party lender, subject to Affirm’s terms, disclosures, and credit approval. BASE 1520 is not the lender and does not make credit decisions; any financing agreement is solely between you and Affirm.

Course refunds. All course payments are non-refundable. If you cannot attend, you may request to transfer your enrollment one time to a future cohort if you notify us in writing at least 30 days before your cohort’s start date and space is available. No-shows, partial attendance, and removals for conduct or safety are not eligible for a refund or transfer. If BASE 1520 cancels a cohort, you may choose a full refund or a transfer. Subscription refunds are addressed in Section 8.

8. App Subscription and Auto-Renewal

The BASE 1520 fitness app (powered by Everfit) is offered on a paid, automatically recurring subscription. When you subscribe, you authorize BASE 1520, through Stripe, to charge your payment method on a recurring basis, on the billing cycle shown for the plan you select, at the then-current price, and your subscription will automatically renew until you cancel.

You may cancel at any time using your in-app account settings or by emailing info@base1520.com. Cancellation takes effect at the end of your current billing period, and you keep access until then. Except where required by law, subscription fees already charged are non-refundable; cancelling stops future charges but does not refund the current period. If we change the subscription price, we will give you advance notice and the opportunity to cancel before the change takes effect.

9. Intellectual Property

All content, course materials, curricula, programming, workouts, assessments, text, graphics, logos, and marks made available through the Services are owned by BASE 1520 or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive license to access and use our content for your own individual, non-commercial use. You may not copy, reproduce, distribute, resell, publicly display, or create derivative works from our materials without our prior written permission.

10. No Warranties

The Services and all content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. While we strive to keep our content accurate and current, we do not warrant that it is complete, reliable, error-free, or up to date, and we may change or update it at any time without notice.

11. Limitation of Liability

To the fullest extent permitted by law — and except for liability that Louisiana law does not allow to be limited, including liability for physical injury and for intentional or gross fault as described in Section 3 — BASE 1520 and its owners, staff, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the website, digital content, or app. To the extent permitted by law, our total aggregate liability for any claim relating to the website, digital content, or app subscription will not exceed the amount you paid to BASE 1520 for the applicable Service in the 12 months before the event giving rise to the claim. Nothing in this Section limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless BASE 1520 and its owners, staff, and contractors from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services or content, your violation of this Disclaimer or applicable law, or your breach of any representation you make to us (including the firearms-eligibility representation in Section 3).

13. Governing Law and Venue

This Disclaimer and your use of the Services are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to this Disclaimer or the Services that is not otherwise governed by the Waiver will be brought exclusively in the state or federal courts located in East Feliciana Parish, Louisiana, and you consent to the personal jurisdiction of those courts.

14. Changes to This Disclaimer

We may update this Disclaimer from time to time. When we do, we will revise the “Effective Date” above. Your continued use of the Services after any update constitutes your acceptance of the revised Disclaimer. We encourage you to review this page periodically.
